Allgemeine Geschäftsbedingungen (AGB)

§ 1 Geltungsbereich, Anbieter

1. Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge, die über den Onlineshop der Anbieterin („Anbieter“) abgeschlossen werden – sowohl für Buchungen von Dienstleistungen als auch für den Erwerb digitaler Produkte.

3. Vertrags­sprache ist Deutsch. Es gilt deutsches Recht. Der Gerichtsstand ist, soweit gesetzlich zulässig, der Sitz der Anbieterin.

4. Für Unternehmer-Kunden (B2B) gelten abweichende gesetzliche Regelungen — soweit in diesen AGB nichts anders geregelt, gelten die folgenden Regelungen auch für Unternehmer.

§ 2 Vertragsschluss

1. Die Darstellung der Produkte und Dienstleistungen im Onlineshop stellt kein bindendes Angebot dar. Mit Anklicken des Buttons „Jetzt kaufen“ bzw. „Jetzt buchen“ geben Sie ein verbindliches Angebot auf Abschluss eines Vertrags ab.

2. Bei Zahlungspflicht wird Ihre Bestellung unmittelbar verarbeitet. Der Vertrag kommt zustande, wenn die Anbieterin Ihre Bestellung durch eine Auftragsbestätigung per E-Mail annimmt oder mit der Leistung beginnt.

   – Bei Buchung kostenpflichtiger Dienstleistungen: Der Vertrag ist mit Zahlungseingang verbindlich. Bei kostenfreien Erstgesprächen gilt der Vertrag mit Termin­vereinbarung.

   – Bei digitalen Produkten: Der Vertrag gilt als angenommen, wenn der Zahlungsvorgang abgeschlossen ist und der Download-Link bereitgestellt wird.

§ 3 Leistungserbringung, Lieferung

1. Digitale Produkte: Nach erfolgreicher Zahlung wird dem Kunden ein Download-Link bereitgestellt, der 24 Stunden lang abrufbar ist. Danach verfällt der Link.

2. Dienstleistungen: Sofern nicht anders angegeben, beginnt die Leistungserbringung innerhalb von 7 Werktagennach Zahlung bzw. Buchung. Für kleinere Leistungspakete (z. B. Social Media Makeover) kann die Ausführung auch schneller erfolgen.

3. Bei Terminbuchung gilt der vereinbarte Termin als Leistungsbeginn.

§ 4 Preise & Zahlungsbedingungen

1. Die angegebenen Preise enthalten – sofern nicht anders gekennzeichnet – die gesetzliche Mehrwertsteuer.

2. Als Zahlungsmöglichkeiten stehen PayPal und Stripe zur Verfügung.

3. Bei Zahlungsausfall oder Rückbuchung kann die Anbieterin die Leistung verweigern.

§ 5 Widerrufs- und Rückgaberecht bei digitalen Produkten

1. Bei Leistungen, die sofort nach Vertragsschluss beginnen oder bei digitalen Inhalten, die unmittelbar nach Zahlung zum Download bereitgestellt werden, kann das gesetzliche Widerrufsrecht erlöschen.

2. Im Falle des Erwerbs von digitalen Produkten über den Onlineshop wird darauf hingewiesen, dass ein Umtausch oder Rückgabe ausgeschlossen ist, sobald der Downloadlink bereitgestellt wurde und die Leistung begonnen hat.

3. Bei Dienstleistungen gelten die Regelungen aus § 6.

§ 6 Stornierung & Umbuchung von Dienstleistungen

1. Stornierung: Bei kostenpflichtigen Terminbuchungen kann bis 48 Stunden vor dem vereinbarten Terminkostenfrei storniert werden. Erfolgt die Stornierung weniger als 48 Stunden vor dem Termin, so behält sich die Anbieterin vor, 40 % des vereinbarten Honorars als Ausfall­entschädigung einzubehalten bzw. nur 60 % Rückerstattung zu leisten.

2. Umbuchung: Eine Umbuchung auf einen Ersatztermin ist einmalig möglich. Erfolgt die Umbuchung mehr als 48 Stunden vor dem Originaltermin, gilt weiterhin die kostenlose Stornierungsregelung. Erfolgt die Umbuchung weniger als 48 Stunden vorher, gilt für den Ersatztermin ebenfalls die Regelung mit 40 % Ausfall­entschädigung.

3. Die Dienstleistung gilt mit der Ausführung oder dem Termin als erfüllt; danach besteht kein Rücktritts- oder Rückerstattungsanspruch.

§ 7 Vertragslaufzeit & Umfang

1. Die über den Shop buchbaren Dienstleistungen sind grundsätzlich einmalig – z. B. 1 x Call oder 1 x Paket.

2. Leistungen mit monatlicher oder längerfristiger Betreuung (z. B. Social Media Management über mehrere Monate) können nicht über den Onlineshop gebucht werden und unterliegen gesonderten Vertragsbedingungen.

§ 8 Nutzungsrechte & Lizenzierung digitaler Inhalte

1. Der Käufer erwirbt an den digitalen Produkten lediglich ein nicht-ausschließliches, nicht übertragbares Nutzungsrecht für die eigene interne Nutzung bzw. Verwendung im Rahmen der vereinbarten Zwecke (z. B. Social Media Verwendung).

2. Jede weiter-gehende Nutzung, Weitergabe, Vervielfältigung oder Veräußerung bedarf der ausdrücklichen schriftlichen Zustimmung der Anbieterin.

§ 9 Haftung

1. Die Anbieterin haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit.

2. Bei leichter Fahrlässigkeit ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt.

3. Eine Haftung für mittelbare Schäden oder entgangenen Gewinn wird ausgeschlossen, soweit gesetzlich zulässig.

4. Die vorstehenden Haftungsausschlüsse gelten nicht bei Verletzung wesentlicher Vertragspflichten („Kardinalpflichten“), deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht.

§ 10 Datenschutz & Newsletter

1. Die Anbieterin verarbeitet personenbezogene Daten der Kunden im Rahmen der gesetzlichen Vorgaben (siehe gesonderte Datenschutzerklärung).

2. Beim Checkout und Buchungsvorgang wird ggf. eine Checkbox angezeigt mit dem Hinweis: „Ich möchte über Neuigkeiten und Angebote informiert werden“. Mit Anklicken willigt der Kunde in den Bezug des Newsletters ein. Die Angabe der E-Mail beim Newsletter ist freiwillig und kann jederzeit widerrufen werden.

§ 11 Schlussbestimmungen

1. Änderungen dieser AGB werden dem Kunden per E-Mail mitgeteilt und gelten als genehmigt, wenn der Kunde nicht innerhalb von vier Wochen widerspricht. Der Kunde wird in der Mitteilung auf die Widerspruchsfrist hingewiesen.

2. Sollte eine Bestimmung dieser AGB unwirksam sein oder werden, so bleibt die Wirksamkeit der übrigen Bestimmungen hiervon unberührt.

3. Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts (CISG).
